
Terms & Conditions

General
These Terms and Conditions form the entire agreement between The Woodyard Ockeridge Limited (henceforth also referred to as “the Company”) and the Customer regarding the subject matter hereof.
No alteration or variation shall be in force unless such change is completed in writing and signed by both parties. All provisions and clauses of the Company’s Terms and Conditions are severable from each other. Any provision or clause of Company’s Terms and Conditions which becomes unenforceable due to voidness, invalidity, illegality, unlawfulness or for any other reason whatsoever, shall to the extent that it is so unenforceable, be treated as not forming part of the contract. The remaining provisions and clauses of Company’s Terms and Conditions shall remain in full force and effect.
The Woodyard Ockeridge Limited reserves the right to revise and amend these Terms and Conditions at any time. Any changes will be posted on our website (www.thewoodyardockeridge.co.uk) and will become effective immediately upon posting. We recommend that you review these Terms and Conditions regularly to stay informed of any updates.
If we make material changes to these Terms and Conditions, we will make reasonable efforts to notify you, which may include sending an email to the address you provided during the ordering process or placing a prominent notice on our website. However, it is ultimately your responsibility to check for updates.
Your continued use of our products or services after any changes to these Terms and Conditions are posted will constitute your acceptance of such changes. If you do not agree to the revised Terms and Conditions, you must discontinue using our products and services immediately.
For orders that have already been placed and accepted by Company before the date of any changes to these Terms and Conditions, the Terms and Conditions in effect at the time of order acceptance will apply to that specific order.
Quotations
Quotations (also referred to as Estimates) shall be provided for all bespoke products / services. Quotations which are provided to the Customer by the Company, are capable of acceptance within a period of 14 (fourteen) days from the issued date of the quotation. Thereafter, the Company will be entitled to either withdraw or alter the quotation.
A contract shall come into existence when the Customer provides the Company with both: written notice (including email) of its acceptance of a quotation given by the Company, within the stipulated 14 (fourteen) days thereof, and when the Company receives receipt of any deposit listed within the quotation provided to the Customer. The company may also provide the Customer with a Service Agreement contract, in this case, the contract shall come into existence when the Customer signs the contract within the stipulated 14 (fourteen) days thereof, and when the Company receives receipt of any deposit listed within the quotation/contract provided to the Client. In all cases the deposit is non-refundable.
The acceptance of a quotation by the customer and/or signing of the service agreement shall be deemed binding. In the event of a cancellation, the request must be submitted within 14 days of the acceptance date and the deposit will be forfeited.
In the event that an accepted quotation or order relates to product(s) that the Company has been expressly or implicitly required to procure, create or alter in order to satisfy the Customer’s requirements, the order or accepted quote may not be cancelled by the Customer.
The Customer acknowledges that the Company’s own and or any third-party sales representatives have no authority to vary any of these terms or conditions of sale and the Company will not be liable or bound by any statements, warranties or representations made by such sales representatives, unless such variations have been expressly stated in writing and signed by a duly authorised representative of the Company.
The Customer may only cancel a contract if the Company agrees to this in writing. Furthermore, the customer may be required to pay reasonable charges based on expenses already incurred.
Purchase Price & Payment
The purchase price of the products shall be paid to the Company in full upon presentation of the relevant invoice, or alternatively for quotation orders via an initial deposit and then a following relevant invoice for the outstanding balance. Products remain the property of the Company until the amount has been paid in full.
Payments made by BACS (Bankers' Automated Clearing System) require up to a 72 hour period for the funds to be received. Products will only be released for collection or delivery once the receipt of funds has been confirmed.
Completion & Delivery
The Customer acknowledges that the completion date of the project and associated delivery date are an estimation and while the Company will endeavour to ensure that completion is completed as soon as is reasonably possible, the Company shall not be liable for delays resulting from any cause(s) beyond its control.
The Company will endeavour to organise and deliver all products United Kingdom wide, with the delivery cost provided upfront to the Customer through the provided quotation.
Risk in and to the product(s) pass to the Customer upon delivery.
Upon receipt of delivery the Customer will inspect the product(s) and must inform the Company of any errors by way of written notice within 7 (seven) days of receipt of the product(s). In the event that the Customer fails to notify the Company of any such claim within the specified time period, such failure shall constitute a waiver of any such claim.
Please measure carefully before ordering to ensure that the product you have ordered will both gain access into your home and fit into the room of choice. Consider doorways, stairways, landings and corners.
Please note that it is the Customer’s responsibility to advise us in writing at time of ordering any access difficulty that may be encountered. Any additional costs associated with delivery, for example window or door removal, is not the responsibility of the Company. Any concerns regarding access must be raised by the Customer at point of sale.
Returns & Refunds
Items purchased from our store or online can be returned for a refund within 14 days of delivery. To qualify for a return, you must have your receipt or invoice, and the item must be in its original, undamaged condition. Discounted or sale items and custom orders are not eligible for return, exchange, or refund.
Cancellation of bespoke orders can be made within 14 days of the quotation being accepted, but as stated above in “Quotations” the deposit is non-refundable.
Returned items must be in the same condition as they were received, along with their original packaging. Once we receive your return and verify its condition, we will issue a refund within 14 days. If you return your entire order, we will also refund the original delivery costs. However, if you only return part of your order, we will not refund the delivery fee. If you need us to collect the returned goods, we may charge a fee.
To return goods by courier, please notify us in writing beforehand by emailing service@thewoodyardockeridge.co.uk. The items should be addressed to: The Woodyard Ockeridge Limited, The Hop Pocket Shopping Village, Bishop’s Frome, Worcester, WR65BT.
Limited Manufacturers Warranty
The Woodyard Ockeridge Limited covers its products under a limited manufacturer's warranty for a period of 1 year from date of delivery/collection in respect of frame and workmanship. Should the original product be altered in any way, the warranty will be void.
The Company will only be liable to honour a warranty if:
The defect existed at the time of delivery and/or manifested during the warranty period.
The defect did not arise due to normal wear and tear or misuse/abuse by the Customer.
The product is used for the purpose intended and in a residential environment, unless a waiver is given in writing by the Company.
The Customer duly complied with the care instructions.
The Customer provides the original invoice.
The colour, texture and composition of resin or wood may vary from the products displayed in store or on the website (www.thewoodyardockeridge.co.uk) due to resin dye/colouring variations and natural timber variations. Live-edge wood is unique, and no two products will be the same. Solid timber products have natural markings, cracks and colour variations due to the nature of the product; these are the characteristics of a natural product and not defects or signs of damage. The wood may display holes, knots, nail marks, scuffs and are considered by part of the natural aesthetic of the product.
For products that use epoxy resin within their construction, the Company warrants that under normal use, proper handling and when the Company’s care instructions have been followed, the product will have no significant resin colour fading within one year (12 months) from date of delivery.
Upon delivery, real wood furniture will acclimatise to its new environment, as the moisture content of the wood adjusts to the humidity and temperature of its new surroundings, potentially causing the wood to split or crack. This is a natural process, however, if this occurs to the product within 1 year of delivery, it shall be considered a defect and thus shall be covered by this warranty.
The Limited Manufacturer’s Warranty does not apply to defects or damage arising from negligence, abuse or misuse, including (but not limited to) improper maintenance, exposure to water, direct sunlight, coastal air, chemicals, accidents, any use for which the product was not designed nor does it cover ordinary wear and tear and failure to comply with the Company’s care instructions or specifications. Extreme use is considered damage caused by more than normal wear and tear this includes:
Solvent and/or other spills.
Ink, pen or crayon marks.
Paint.
Bodily fluids (human or animal).
Improper cleaning techniques.
Placing furniture in direct sunlight or in close proximity to an open heat source heaters, fire places, etc.
Extended Warranty
The company offers the option to purchase an extended warranty to the Customer. The purchase of the extended warranty can be made between accepting a quotation and up to and including the date of delivery. The extended warranty for a product can not be purchased after the delivery date. For larger repairs outside of warranty coverage, the customer shall be advised to seek the paid repair service offered by the Company.
The extended warranty provides one repair within the coverage period for:
Minor surface damage, including small scratches and light dents.
Resin touch-ups for small chips.
Refinishing services, such as reapplying oil or a protective topcoat.
The extended warranty does not cover:
Structural failure or defects beyond the 12-month Limited Manufacturer’s Warranty.
Damage caused by misuse, neglect, or improper care.
Heat damage, water stains, or excessive exposure to sunlight.
Wood movement, resulting in warping, or cracking/splitting due to environmental factors (e.g., humidity and temperature changes).
More than one repair during the coverage period.
The Customer must submit a claim via email with proof of purchase and clear photos of the damage. Claims must be reported within 14 days of the damage occurring to qualify. The company reserves the right to determine whether a repair will be performed at the customer's location or in the Company’s workshop.
The extended Warranty only applies to the original owner and is non-transferable. Repairs are performed at our discretion; replacement and/or refund of product is not an option under the extended warranty. Any repairs attempted by third parties will void the extended warranty. The company reserves the sole discretion to determine whether a repair is covered by the extended warranty and thus reserves the right to refuse repairs that exceed reasonable expectations or where the table has been severely damaged due to neglect, misuse, or environmental factors.
Looking After Your Furniture & Your Duty Of Care
The Company will provide the Customer with advice on how to look after their product(s) and supply a detailed care guide upon delivery. It is crucial that the Customer follows the care advice as this will prolong the life of the product(s) and maintain its appearance and functionality accordingly. Failure to follow the care guide may result in the product(s) wearing more quickly and may be detrimental to its appearance or longevity. The Company cannot be held responsible for issues arising with items that have not received adequate or correct care or maintenance and our guarantee does not cover such items nor general wear and tear.
Condition of Displayed Products
If the subject of the sale is a product that is on display in a showroom as seen and chosen by the Customer, then the product is sold to the Customer in the specific condition in which it is seen, and the Customer agrees to accept the chosen product in that condition. The product is not applicable for return or refund.
Intellectual Property
All intellectual property rights in and to the products, designs, and materials supplied by The Woodyard Ockeridge Limited, including but not limited to copyrights, trademarks, design rights, patents, and trade secrets (collectively, 'Intellectual Property Rights'), are and shall remain the exclusive property of The Woodyard Ockeridge Limited or its licensors.
Customers are granted a limited, non-exclusive, non-transferable license to use the products for their intended purpose in a residential environment, as outlined in these Terms and Conditions. This license does not grant any right to reproduce, modify, distribute, or create derivative works based on the Intellectual Property Rights without the express written permission of The Woodyard Ockeridge Limited.
Any unauthorized use of the Intellectual Property Rights is strictly prohibited and may result in legal action. The Customer acknowledges that any ideas, suggestions, or feedback provided to The Woodyard Ockeridge Limited regarding the products or services may be used by The Woodyard Ockeridge Limited without any obligation to compensate or credit the Customer.
All graphical images relating to the Company and its products, including but not limited to photos, logos and banners, displayed in publications or appearing on the website (www.thewoodyardockeridge.co.uk) are the property of the Company. Any unauthorised use, reproduction or distribution thereof is strictly prohibited.
Data Protection
The Woodyard Ockeridge Limited is committed to protecting the privacy and security of your personal data in compliance with the General Data Protection Regulation (GDPR). Our practices regarding the collection, use, and disclosure of your personal data are outlined in our separate Privacy Policy, which is available on our website (www.thewoodyardockeridge.co.uk) or can be provided upon request. By agreeing to these Terms and Conditions, you acknowledge that you have read and understood our Privacy Policy and consent to the collection, use, and disclosure of your personal data as described therein.
Limitation of Liability
The Company will only be liable for damages that may be suffered by the Customer as a result of gross negligence or a wilful or intentional act or omission on the part of the Company.
Images & Publications
All graphical images relating to the Company and its products, including but not limited to photos, logos and banners, displayed in publications or appearing on the website (www.thewoodyardockeridge.co.uk) are the property of the Company. Any unauthorised use, reproduction or distribution thereof is strictly prohibited.
Indemnity
In the event of a breach of contract being committed by the Customer or in a situation where the Company is required to take legal action, the Customer agrees to fully indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions.
Governing Law
These terms are governed by and interpreted in accordance with the laws of England and Wales and the courts of the above jurisdiction will have exclusive jurisdiction in respect of any dispute which may arise.
